Karnataka High Court Reserves Decision on Actor Darshan’s Bail Plea, Medical Grounds Strengthen Chances of Release

The Karnataka High Court on Tuesday reserved its verdict on the bail plea of Kannada superstar Darshan, who is currently imprisoned. The court is expected to deliver its decision on Wednesday. Darshan, dealing with severe health issues, has requested bail on medical grounds through his legal team.

Justice M. Nagaprasanna’s bench heard senior advocate C.V. Nagesh, representing Darshan, who argued that the actor is suffering from a severe spinal issue, causing numbness and pain in his legs. Nagesh informed the court that if left untreated, Darshan could face additional serious health complications.

He explained that Darshan has a disc issue in his spine, restricting blood flow in his body. Medical professionals have advised surgery, as other treatments are deemed ineffective. Nagesh clarified that due to Darshan’s worsening condition, this bail application on medical grounds was necessitated.

Citing his client’s right to health, Nagesh emphasized that it is a fundamental right for every individual, urging the court to grant bail to Darshan accordingly. He also referenced multiple Supreme Court rulings supporting this right.

SPP Opposes Bail Plea
Special Public Prosecutor (SPP) Prasanna Kumar opposed Darshan’s bail plea, asserting that the medical report only indicates potential future complications. Kumar pointed out that the report lacks specific details regarding the urgency of surgery, its duration, and location.

In response, advocate Nagesh informed the court that Darshan is originally from Mysuru and has previously received treatment at Apollo Hospital there. This time, too, they intend to proceed with treatment there, and none of the case witnesses are from Mysuru.

Awaiting the Decision
Justice Nagaprasanna questioned the SPP about the right to health for undertrial prisoners and suggested considering Darshan’s medical report for a well-rounded decision. Darshan’s family and fans are hopeful for his release before Diwali, with experts indicating a strong likelihood of bail on health grounds.

The Kannada film industry superstar Darshan has been in jail for four months. He, his friend Pavitra Gowda, and 15 others were arrested on June 11 this year in connection with the alleged kidnapping and murder of Chitradurga resident Renukaswamy. According to allegations, Renukaswamy, a fan of Darshan, was angered by Darshan’s relationship with Pavitra Gowda.
